MCA filing of form INC-22A (Active)
Ministry Of Corporate Affairs amended the Companies (Incorporation) Rules, 2014 by adding a new form i.e INC-22A(ACTIVE), here ACTIVE stands for Active Company Tagging Identities and Verification.
Every company registered on or before 31st December 2017 are required to file INC-22A containing the information of the company and its registered office, on or before 25th April’2019. (however, companies whose due financial statements or annual returns or both are not filed up to 31st March, 2018 cannot file INC-22A, except the companies under dispute).”
Following details are required to be furnished in the stated form:
- Company details
- Statutory and cost auditor details
- KMP Details, etc.
- SRN of e-form AOC- 4 & MGT- 7 for FY 2017-18.
Following categories of companies are not required to fill the form :
- Struck off companies
- Companies under the process of striking off
- Companies under liquidation
- Companies amalgamated or dissolved, as recorded in the register
In case of non- compliance of the above rule, the company shall be marked as “ACTIVE non-compliant” on or after 26th April, and also the following e-forms shall not be accepted
- SH-07 (Change in Authorized Capital)
- PAS-03 (Change in paid-up capital)
- DIR-12 (Changes in director except for cessation)
- INC-22 (Change in Registered office)
- INC- 28 (Amalgamation, de-merger)
If a company files “e-form ACTIVE”, on or before 26th April 2019, the company shall be marked as “ACTIVE Compliant”, on payment of fees of Ten Thousand Rupees.
